This research proposal aims at analysing the role of criminal law in the
protection of food safety, with regard to the liability of individuals and
The research will be structured along three main strands.
First, it will focus on the analysis of the Italian legislation to counter
food crime and of the conformity to principles of the drafting techniques for
anticipating criminal protection that characterise this sector.
Secondly, the role played by legal persons in these criminal enforcement
systems will be examined, investigating the limits of the Italian legislation
with respect to an adequate liability regime of legal persons for food crimes
committed in their interest or to their benefit.
The last part of the research – once the reform needs emerging from the
current legal framework have been identified – will be devoted to the analysis
of the de iure condendo perspectives, also taking into account the EU
dimension of this matter.
